Terms of Service

These Terms of Service ("Terms") govern your use of the Wandering Library mobile application and website (together, the "Service"), operated by Wandering Library LLC, 2 Lisa Ln, North Reading, MA 01864, United States.

By using the Service, you agree to these Terms. Where the app presents these Terms for acceptance, you must affirmatively indicate your agreement before continuing. If you do not agree to these Terms, do not use the Service.

Our Privacy Policy explains what information the Service collects, how it is used, and the choices available to you. The Privacy Policy is part of the overall terms governing your use of the Service.

1. The Service

Wandering Library is a reading application. It delivers historical passages — including letters, newspaper accounts, petitions, engravings, and other historical materials — at or near the places they describe, organised into curated Editions.

Editions are versioned data sets delivered to the app. Their contents, locations, citations, availability, and presentation may be corrected, expanded, reorganised, or withdrawn over time.

The Service is provided for historical, educational, and recreational purposes. It is not an authoritative navigation service, emergency service, accessibility service, or substitute for information supplied by public authorities or property owners.

2. Walk carefully

The Service asks you to walk around a real city. Your safety is your own responsibility.

Pay attention to traffic, bicycles, pedestrians, footing, weather, construction, crowds, and your surroundings rather than to your phone. Do not use the Service while driving or operating a vehicle. Pull over or stop in a safe place before reading or interacting with the app.

Do not trespass on private property, enter restricted areas, or disregard posted hours, closures, barriers, warnings, or the instructions of property owners, government officials, or property staff. Nothing in an Edition is an invitation or authorization to enter a place where you are not permitted to be.

Location information and geofences may be inaccurate or unavailable. Do not rely on the Service for precise directions, property boundaries, emergency response, or any decision where inaccurate location information could cause injury or harm.

3. Historical sources and editorial material

Passages are drawn from public-domain and openly licensed sources and, where appropriate, carry citations or licence information. Historical documents reflect the beliefs, prejudices, assumptions, and language of their own time, and some contain material that readers will find offensive or disturbing. Presenting a historical document is not an endorsement of its contents.

We select and arrange sources with the aim of presenting history from a range of perspectives, including perspectives that may be absent from traditional historical markers and accounts.

We make reasonable efforts to provide accurate transcriptions, attributions, dates, quotations, citations, and locations. Historical records and source materials can nevertheless contain uncertainty or error, and the Service may contain mistakes. We do not guarantee that every transcription, attribution, date, quotation, or location is correct or complete. If you find a mistake, please tell us.

4. Your Portfolio

Passages you collect may be recorded in your Portfolio. Portfolio records are intended to reflect your use of the Service and are stored on your device unless the Service expressly states otherwise.

We do not claim ownership of your Portfolio records merely because they are stored or displayed by the Service. The historical source material represented in a Portfolio remains subject to its applicable public-domain status, licence, or other rights.

Because Portfolio data is stored on your device and we do not presently maintain a server-side copy that we can restore, you are responsible for backing up your device if preserving your Portfolio is important to you. We are not responsible for Portfolio data lost because of device failure, loss, damage, operating-system changes, deletion of the app, or other events outside our reasonable control.

5. Location services

Some features require access to your device's location. Location access is used to support features such as determining which passages or places are relevant to where you are.

You may control location permissions through your device's operating-system settings. Turning off location access may prevent some features from working. The Service does not guarantee that location-based features will operate reliably in every environment, including areas with weak satellite signals, tall buildings, indoor locations, underground areas, or other conditions that interfere with positioning.

You may use the Service only for lawful purposes and in accordance with these Terms. You must not:

7. Intellectual property and licences

Historical source materials may be in the public domain or made available under open licences. The rights associated with those materials belong to their respective public-domain status, licensors, or rights holders and are not enlarged by these Terms.

Subject to those underlying rights, the Wandering Library software, original written and editorial material, Edition curation and arrangement, original illustrations or other creative assets, website design, and the Wandering Library name and marks are owned by Wandering Library LLC or its licensors.

Map data and map services may be provided by third parties and remain subject to their own licences and terms. Required attribution and licence information may be displayed in the app or elsewhere in the Service.

Except for rights expressly granted by these Terms or by an applicable source licence, no licence or other right to the Service's software, branding, editorial material, or other protected content is granted to you.

8. Accounts

The Service currently does not require an account or registration. There are therefore no Wandering Library credentials for you to maintain.

If we introduce accounts or other identity-based features in the future, we may provide additional terms or update these Terms before those features are used.

9. Age requirements

The Service is intended for a general audience and is not directed to children under 13. If you are under 13, do not use the Service or provide personal information through it.

We do not knowingly collect personal information from children under 13. If you believe that a child under 13 has provided personal information to us, please contact us so that we can review the situation and take appropriate action.

10. Availability and changes to the Service

We may add, change, suspend, or discontinue features, Editions, locations, source materials, or other parts of the Service at any time. We do not promise that a particular Edition, passage, feature, location, or version of the Service will remain available.

We may also correct errors, update historical or geographic information, change technical requirements, or make other changes necessary to operate, maintain, or improve the Service.

11. Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will update the effective date above and, where reasonably practicable, provide notice through the Service before the change takes effect.

Where applicable, we may ask you to affirmatively accept revised Terms before continuing to use the Service. Changes will not affect rights or obligations that accrued before the effective date of the revised Terms, except where applicable law permits otherwise.

12. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, accurate, complete, current, error-free, or available at any particular time or place. We specifically do not warrant that geofences, GPS or other positioning features, historical locations, map data, source transcriptions, citations, or other information will be accurate or reliable in every circumstance.

Nothing in these Terms excludes or limits any warranty or other right that cannot lawfully be excluded or limited under applicable law.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WANDERING LIBRARY LLC AND ITS LICENSORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud or for other matters for which applicable law prohibits limitation.

14. Third-party services and app stores

The Service may depend on or interoperate with third-party services, including mobile operating systems, app stores, mapping services, location services, and other infrastructure. Those services are controlled by their respective providers, and their availability and operation are outside our control.

If you obtain the app through Apple, Google, or another app store, your use of that store is also subject to the store's applicable terms and policies. Those providers are not responsible for providing support or maintenance for the Service unless their own terms expressly require it.

15. Suspension or termination

We may suspend or terminate your access to the Service, or discontinue the Service altogether, if reasonably necessary to protect the Service, comply with law, address misuse, or operate the business. We may also terminate or suspend access to particular features or Editions without terminating the entire Service.

Sections concerning intellectual property, disclaimers, limitations of liability, governing law, dispute resolution, and any other provisions that by their nature should survive termination will survive termination of these Terms.

16. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules.

Subject to any mandatory rights or remedies available to you under the law of your place of residence, any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in the Commonwealth of Massachusetts, and you consent to the jurisdiction of those courts.

Nothing in this section is intended to deprive a consumer of protections or remedies that cannot legally be waived under the law applicable to that consumer.

17. General terms

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce a provision of these Terms is not a waiver of our right to do so later.

These Terms, together with the Privacy Policy and any other terms expressly incorporated by reference, constitute the agreement between you and Wandering Library LLC concerning the Service and supersede prior agreements concerning the same subject matter.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation, sale of assets, or similar transaction.
